This page explains our terms of use. When you use Virtus Care, you’re agreeing to all the rules on this page. Some of them need to be expressed in legal language, but we’ve done our best to offer you clear and simple explanations of what everything means.
Welcome to Virtus Care. By using this website (the “Site”) and services, you’re agreeing to these legally binding rules (the “Terms”). You’re also agreeing to our Privacy Policy and agreeing to follow any other rules on the Site.
We may change these terms from time to time. If we do, we’ll let you know about any material changes, either by notifying you on the Site or by sending you an email. New versions of the terms will never apply retroactively — we’ll tell you the exact date they go into effect. If you keep using Virtus Care after a change, that means you accept the new terms.
2.About Creating an Account
To sign up for a Virtus Care account, you need to be 18 or over. You’re responsible for your account and all the activity on it.
You can browse Virtus Care without registering for an account. But to use some of Virtus Care’s functions, you’ll need to register, choose an account name, and set a password. When you do that, the information you give us has to be accurate and complete. Don’t impersonate anyone else or choose names that are offensive or that violate anyone’s rights. If you don’t follow these rules, we may cancel your account.
You’re responsible for all the activity on your account, and for keeping your password confidential. If you find out that someone’s used your account without your permission, you should report it to support@Virtus Careinc.com.
To sign up for an account, you need to be at least 18 years old, or old enough to form a binding contract where you live. If you registered a doctor account, we may ask you for practicing certificate and/or license.
3. Stuff We Don’t Do and Aren’t Responsible For
We don’t oversee clinics’ performance, and we don’t mediate disputes between users.
Virtus Care isn’t liable for any damages or losses related to your use of the Services. We don’t become involved in disputes between users, or between users and any third party relating to the use of the Services. We don’t oversee the performance or punctuality of clinics, and we don’t endorse any content users submit to the Site. When you use the Services, you release MypPlatform from claims, damages, and demands of every kind — known or unknown, suspected or unsuspected, disclosed or undisclosed — arising out of or in any way related to such disputes and the Services. All content you access through the Services is at your own risk. You’re solely responsible for any resulting damage or loss to any party.
The Doctor listed on the Site is a Medical Practitioner holding a valid and subsisting practising certificate under the Medical Registration Ordinance (Cap. 161, Laws of Hong Kong) practicing on his own account in private consulting rooms situated at the Medical Centre.
4. Obligations of the Doctor
4.1 If you registered a doctor account, you undertakes with the Site as follows:-
- that he will maintain a high standard of ethical medical practice and will comply in all respects with the provisions of the law and the pamphlet entitled "Professional Code and Conduct for the Guidance of Registered Medical Practitioners" (the "Medical Code") laid down by the Medical Council;
- that he will provide Services and act professionally towards all Relevant Patients and Referred Patients to the same standard of care as the Doctor's Patients subject to Contract Limits of the Relevant Contract;
- that he will at all times comply with the terms (including the terms updated from time to time by the Site) of the Relevant Contracts;
- that he will keep full and proper clinical records and records of the Services provided by him to Relevant Patients;
- that he will effect and maintain at his own expenses, professional indemnity insurance to an amount and in terms reasonably approved by the Company; and
- that he will indemnify the Site, and its directors, shareholders, officers and employees from and against all or any liabilities, damages, claims, actions, costs and expenses of any kind which may be imposed on, suffered or incurred by the Site and/or any such directors, shareholders, officers or employees in any way relating to or arising out of the practice of the Doctor or the Services provided by or to the Doctor hereunder.
4.2 The Site may terminate your account at any time by notice in writing to the Doctor if the Doctor fails to perform any of his obligations under Clause 4.1.
4.3 Representations and Warranties of the Doctor The Doctor represents and warrants to the Site that:-
- he is not bound by or subject to any court order, agreement, arrangement or undertaking which in any way restricts or prohibits him from entering into this terms of use or the performance of his obligations hereunder;
- he is duly registered as a medical practitioner in Hong Kong by the Medical Council of Hong Kong (the "Medical Council");
- he is protected by professional indemnity insurance complying with clause 4.1(e);
- he has not been convicted of any criminal offence (other than a minor traffic violation);
- no bankruptcy order has been made against him and he has not filed any bankruptcy petition; and
- he has not been found guilty of misconduct in a professional respect by the Medical Council or other professional bodies in Hong Kong or any professional bodies elsewhere.
5. Law and jurisdiction
This terms of use shall be interpreted in accordance with the Laws of Hong Kong and the parties hereto irrevocably submit to the non-exclusive jurisdiction of the Courts of Hong Kong.
